  • Collected by us offline or through any other means, including on any other website operated by Company or any third party; or
  • any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website or App.

II. Persons Under the Age of 18.

Neither our Website nor App is not intended for persons under 18 years of age. III. Information We Collect About You; How We Collect It.

(A) We collect several types of information from and about users of our Website and App, including information:

  • Provided by you when you register as a user for a Erthie Account;
  • Provided by you when you register as a user for a Erthie Account using your Social Media account (defined below), you authorize us to access certain account information, such as your public profile (consistent with all privacy settings set by you on the Social Media service provider and its services), your email address, interests, likes, gender, birthday, education history, current city, photos, personal description, friend list, and information about and photos of your friends who might be common friends with other App users ("personal information"). Further, you will be asked to allow App to collect your location information from your device when you download or use our Services, the Website, or App, including identifying information, such as your name, address, email address and telephone number, and, if you transact business with us, some financial information. If you chat with other App users or our Erthie Account support team using any of our Services, you provide us the content of written chat transcripts. We will use the identifying information you provide us to populate the filters available to users in the Website or App, including age and gender details. We may share or disclose your non-private, aggregated or otherwise non-personal information with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and services and for marketing and analytics purposes. You may opt-out of receiving marketing messages by using the opt-out mechanisms and links provided in each email;
  • that is about you but individually does not identify you; or
  • about your internet connection, the equipment you use to access our Website or App, and usage details.

(B) We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
  • Automatically from your mobile device when you use our Services, including your IP address, device ID and type, operating system, MAC address, browser type and language, the operating system, access times, geographic location while the application is actively running, and any referring website address. In addition, when using our app we use mobile device IDs or Advertising IDs, instead of cookies (described later), to recognize users. We do this to store preferences and track use of App; advertising companies do this to track the number and performance of advertisements that may be more relevant to you.

(C) App may allow access to or make available opportunities for you to view certain content and receive other products, services or other materials provided by us or third parties based on your location. To make these opportunities available to you, App will determine your location using one or more reference points, such as GPS, Bluetooth or software within your mobile device. If you have set your mobile device to disable GPS, Bluetooth or other location determining software or do not authorize App to access your location data, you will not be able to access such location-specific content, products, services and materials. In addition, App will not function as intended by the Company.

(D) The information we collect on or through our Website or App may include:

  • Information that you provide by filling in forms on our Website or App. This includes information provided at the time of registering for the Website and App (as defined in the Terms of Use). We may also ask you for information when you report a problem with our Services.

  • Speed up your searches and overall application infrastructure.

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer or mobile device. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website or App. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website or install App on your mobile device.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To perform research and analysis about your use of, or interest in, our or others' products, services, or content.
  • To communicate with you be email, telephone, postal mail, or mobile devices about products, venues, or services that may be of interest to you either from us or other third parties.
  • To develop, display, and track content and advertising tailored to your interests on the Website or App.
  • To provide or analyze Website or App analytics.
  • To verify your eligibility and deliver prizes in connection with any contests and sweepstakes.
  • To notify you about changes to our Website, App, or any products or services we offer or provide though it.

Also, if you access our Website or App from a third party social platform including, but not limited to, Facebook, Google+, Twitter, Pinterest, LinkedIn, Instagram, or other social media platforms (collectively, "Social Media") we may share non-personal information with that platform to the extent permitted by your agreement with it and its privacy settings. Please note that this Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Website or App.

(C) If you are a job applicant or service provider to the Company, and your personal information is submitted through the Website or App when applying for a position or job with the Company, the information will be used solely in connection with considering and acting upon your application materials. We may retain your personal information, but only for the purpose of considering your application for current or future available positions or jobs. (D) If you contact our Erthie Account or Merchant Account support team through the Website or App, we will receive your email address, and may track your IP address as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints or reports that we receive from you about other users (and from other users about you). We will not provide you information about users who report you.

VI. Disclosure of Your Information.

(A) We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our Merchants, subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of The Green Club Inc.'s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by The Green Club Inc. about App or Website users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.

IX. Blocking or Reporting other users or Merchants.

All registered users having a Erthie Account or Merchant Account will have the ability to report or block someone to prevent them from seeing things you post on your profile, starting conversations with you or adding you as a favorite or friend, including blocking any other users or service providers on the Website or App. In order to submit a report, users may email the address provided below in this Privacy Policy; upon Company's sole review and determination, the offending user, Merchant, or service provider will be blocked. As a registered user, blocking someone or a service provider means they won't be able to see things you post using your profile, including any User Uploads, add you in any User Uploads, start a conversation with you, or add you as a favorite. Blocking someone, a Merchant, or a service provider may not prevent all communications or interactions, and Company will exercise commercially reasonable efforts to help enforce the extent to which another user or service provider is completely blocked. If you block a friend, Merchant or service provider and then unblock them, the terms of this Privacy Policy (as may be updated) will be deemed to apply.

X. Deactivation; Termination of Your Erthie or Merchant Account.

When your Erthie Customer or Merchant Account is deactivated or terminated, for any or no reason as may be determined by the Terms of Use (including the Merchant Terms of Use), we take reasonable efforts to make sure it is no longer viewable on the App. For up to 30 days it is still possible to restore your account if it was accidentally or wrongfully deactivated or terminated based on your report to [email protected] or [email protected]. After 30 days, we begin the process of deleting your account from our systems. We are not responsible for any information, pictures, comments, or other content that is deleted from our systems resulting from the deactivation of your account. In addition, we make no warranties or representations based on your information provided to Social Media, which shall be subject to such Social Media's respective terms of use, conditions, and relevant documents.
To prevent abuse of the Website or App by a user or Merchant following termination or deletion of an account, we shall retain such information as we deem in our sole discretion may be necessary to ensure that the user or Merchant does not open a new account or profile in violation of our Terms of Use (or Merchant Terms of Use), other restrictions, and to ensure compliance with all laws and regulations.
After you remove information from your profile or delete your Erthie or Merchant Account, copies of that information may still be viewable or accessed to the extent such information has been previously shared with others, or copied or stored by other users or to the extent such information has been shared with search engines. We cannot control this, nor do we accept any liability for this. If you have given third party applications or websites access to your personal information, they may retain such information to the extent permitted subject to their respective terms of service or privacy policies. Removed and deleted information may persist in backup copies owned by the Company for up to 30 days to enable restoration or reactivation subject to successful appeal to Company, but will not be available to other users in the meantime.

XI. Your California Privacy Rights.

California Civil Code Section 1798.83 permits users of our Website or App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
